Case Result: Immigration Client Released from Jail on Bond
On Friday, January 15, 2016 I was set to proceed with an individual hearing for a detained immigration removal case in San Francisco. The client overstayed after entering the United States on the visa waiver program, so he had limited procedural rights. He switched attorneys in the middle of the case, and ended up being detained for over 180 days by the time his individual hearing was set to proceed. He was applying for only for withholding of removal. At the hearing, the judge granted my previously filed motion for a bond hearing and proceeded with a hearing on bond to begin the proceedings, over the government’s objection. The judge was ultimately persuaded by our position and set a bond for my client, who is now out of jail.
