On June 6, 2020, three CHP officers shot and killed Erik Salgado and wounded his pregnant girlfriend Brianna Colombo. In a statement released late Tuesday, OPD said the officers opened fire after Salgado rammed his car into CHP vehicles.

Neighbors reported that over 30 shots were fired, from assault rifles. CHP seized video of the shooting from neighbors and has not released any footage of the incident. Mr. Salgado was killed a block from his family’s home.  He leaves behind a 3-year-old daughter.

The CHP has not released any video of the incident. In fact, according to Mr. Bond Graham, The CHP’s refusal to provide information about the incident is not unusual. California Highway Patrol has not released any records regarding its officers’ past use of deadly force, despite a state law that went into effect on Jan. 1, 2019, requiring police to disclose previously confidential investigative records about shootings and other fatal incidents. KQED is currently suing the CHP over its refusal to hand over these records. The Oaklandside also put in records requests with CHP, but has yet to receive a single file.

The DA in Alameda County is currently investigating the matter. On June 8, around 1,000 Oakland residents and activists gathered on the grass at Elmhurst School on 98th Avenue, about one block from the scene of the shooting. Salgado’s family members joined the protest as it marched to his shrine.

“We don’t need the police,” George Galvis, an organizer of the march told the crowd before they stepped into 98th Avenue. “We don’t need police protection. We need protection from the police.”

On March 4, 2020, Bob Egelko of the San Francisco Chronicle published an article about this local appellate division case.  The appellate division is a division of local courts that handle appeals of misdemeanors.  Felony appeals are handled by the Courts of Appeal.

Anyhow, the appellant in this case was stopped for driving without a front license plate by a police officer on “specialized DUI patrol.”  The officer didn’t smell alcohol, but he did smell marijuana.  The driver was cooperative and told the officer he had “some bud” in the center console.  A search of the console revealed he had a little over a gram, well within the legal limits proscribed by Proposition 64  “Believing there might be more marijuana in the car, the officers searched further and found no drugs, but discovered a loaded pistol under the driver’s seat” writes Egelko. 

The trial court ruled the search was legal, but the appellate division reversed.  “The possession of the cannabis flower in this case was lawful,” Presiding Judge Noel Wise said in the 3-0 ruling. She said it was properly enclosed in a container and was only a fraction of the one-ounce maximum allowed by Prop. 64

Prosecutors argued that police still had grounds to search the car and would have found the gun. But Wise said the only evidence officers had was the strong smell of fresh and recently burnt marijuana and Shumake’s statement that he possessed a small amount of the drug, not enough to justify a search of a driver who was cooperating and showed no signs of impairment.

“Anyone 21 years and older can now lawfully smoke marijuana in California and, as (the officer) testified, the smell can linger for more than a week,” Wise said. “Given the legality of personal use of marijuana in the state of California, there was not a fair probability that (the officer) would find evidence of a crime” in a legal search.

The appellant was represented on appeal by the well-respected Charles Denton of the Alameda County Public Defender’s office.

In August 2019, the District Attorney dismissed a felony unlawful firearm activity case, 2 months ahead of our scheduled jury trial.  My client was accused of illegally possessing a firearm, but our position from the outset of this case was that he did so in self-defense.  We filed a discovery motion after some key items of evidence for trial were not provided, and rather than receiving a ruling on the motion, the District Attorney moved to dismiss.

We were able to provide them with a video of the incident in question, which exonerated my client.
